Terms of Service

1. Acceptance of Terms

By accessing or using the PAYGabo platform, you agree to be bound by these Terms of Service. If you do not agree, do not use our platform. These terms constitute a legally binding agreement between you and PAYGabo.

2. Description of Service

PAYGabo is a payment processing platform that enables businesses in Ghana to accept payments via Mobile Money (MTN MoMo, Vodafone Cash, AirtelTigo Money), bank transfers, and debit/credit cards. Our platform provides transaction processing, reconciliation, settlement, and reporting tools through a dashboard and REST API.

3. Eligibility

Our services are available only to registered businesses operating in Ghana. You must provide accurate and complete business registration information during onboarding. We reserve the right to verify your business details and decline service if eligibility requirements are not met.

4. Account Responsibilities

You are responsible for maintaining the security of your account:

• Keep your login credentials and API keys secure and confidential.
• Notify us immediately at support@paygabo.com if you suspect a security breach or unauthorized access.
• You are liable for all activity that occurs under your account.

5. Payment Terms

Transaction fees are as listed on our pricing page. Settlement timelines depend on your payment provider and plan. We do not hold your funds — payments settle directly to your designated provider sub-account. Fees are deducted per transaction and are non-refundable once a transaction has been processed.

6. Prohibited Activities

You agree not to use PAYGabo for any of the following:

• Fraudulent transactions or activities that deceive payment providers or customers.
• Money laundering or financing of terrorism as defined under applicable AML/CFT regulations.
• Any illegal activity under the laws of Ghana.
• Processing payments for prohibited goods, services, or sanctions targets.
• Circumventing transaction limits or fee structures.

Violation of these restrictions may result in immediate suspension or termination of your account.

7. Intellectual Property

PAYGabo retains all intellectual property rights to the platform, including its code, design, documentation, and branding. You retain full ownership of your business data, transaction records, and customer information. You grant us a limited licence to process your data solely to provide our services.

8. Limitation of Liability

PAYGabo shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability in any claim arising from or related to these terms shall not exceed the fees you paid to PAYGabo in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement with 30 days' written notice. We may terminate or suspend your account immediately if you breach these terms, engage in prohibited activities, or if required by law. Upon termination, you may request export of your data within 90 days.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Ghana. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
